These Terms & Conditions ("Terms") govern your use of Sold (the "Service"), an AI-powered sales training simulator operated by Galabina ("we", "us", the "Seller"). By creating an account or continuing to use the Service, you agree to these Terms. You are contracting with Galabina.

1. The Service

Sold lets you practice sales conversations against an AI buyer, receive a scored verdict on your performance, and generate a recommended sales script for your product. Some features require a paid "Pro" subscription.

2. Eligibility and accounts

You must be of legal age in your jurisdiction to use the Service. You must provide accurate information when signing up and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Pro subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period. See our Refund Policy.

4. Acceptable use

You must not misuse the Service, including:

• Using the Service for any unlawful purpose, fraud, or spam.
• Infringing intellectual property rights of any third party.
• Interfering with the security or operation of the Service, including introducing malware, probing, scanning, or scraping.
• Reverse engineering, reselling, or redistributing the Service, or circumventing technical limits (including usage limits of the free plan).

Because the Service uses generative AI, you also must not:

• Generate illegal content, deepfakes, hate speech, or malware.
• Attempt to jailbreak or manipulate the AI models into bypassing their safeguards.

You are responsible for the content you input (including product descriptions), for how you use the AI outputs, for verifying their accuracy before relying on them, and for having the rights to any content you submit.

5. AI-generated content

Practice conversations, verdicts, and recommended scripts are generated by AI and may be inaccurate. They are provided for training purposes only and are not professional, legal, or business advice. IP rights in your inputs remain yours; we claim no ownership of the scripts generated for you. If you believe content infringes your rights, contact us and we will remove it. Repeated infringement may lead to account termination. We may remove or restrict content, filter outputs, or suspend accounts that violate these Terms.

6. Intellectual property

We retain all ownership of the Service and its intellectual property, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You grant us a limited license to host and process the content you submit solely to provide the Service.

7. Service level

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, your session history and scripts may be deleted after a reasonable period.

9. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim, and we exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

10. General

You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. These Terms are governed by the laws of the Seller's jurisdiction. If any provision is held unenforceable, the remainder stays in effect.
